These Terms of Service are an agreement formed between you and FaceXSwap. They cover the website available at FaceXSwap (the “Website”), and the FaceXSwap mobile application (the “App”). In these Terms we will sometimes refer to FaceXSwap as “FaceXSwap”, “Company”, “we”, or “us”. We’ll refer to our Website and App, together with any content, tools, features and functionality offered on or through them, as the “Services”.

These Terms govern your access to and use of the Services. Please read them carefully, as they include important information about your legal rights. By accessing or using the Services, you’re agreeing to these Terms. If you don’t understand or agree to these Terms, please don’t use the Services.

In these Terms, “you” and “your” means you as the user of the Services. If you use the Services on behalf of a company or other entity then “you” includes you and that entity, and you represent and warrant that (a) you are an authorized representative of the entity with the authority to bind the entity to these Terms, and (b) you agree to these Terms on the entity’s behalf.

NOTE: THESE TERMS CONTAIN AN ARBITRATION CLAUSE AND CLASS ACTION WAIVER. By agreeing to these Terms, you agree to resolve all disputes with us through binding individual arbitration. That means you also waive any right to have those disputes decided by a judge or jury, and you waive your right to participate in class actions, class arbitrations, or representative actions. You have the right to opt out of arbitration as explained below.

Use of the Services

Your Registration Obligations. When you register to use the Services, you agree to provide accurate and complete information about yourself. If you are under 9 years old, do not sign up for the Services – you are not authorized to use them.

Member Account, Password and Security. You are responsible for maintaining the confidentiality of your password and account, and for all activities that occur under your password or account. You agree to immediately notify FaceXSwap of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session when accessing the Services. FaceXSwap will not be liable for any loss or damage arising from your failure to comply with this paragraph.

Contents. FaceXSwap provide you with a non-exclusive license to use the App to access contents published by us and other users, and to upload UGC(User Generated Content) in the App. Through the App, users can get an access to such functions as: (a) free access to browsing contents; (b) free access to uploading UGC in the App; (c) Paid access (In App Purchase or Subscription) to downloading contents for personal and commercial use.

Email Notifications. You consent to receive notifications from us electronically to the e-mail address you provide to us. These notifications may be about your account, changes to our service, or other updates or marketing relating to our platform.

Prohibition of Misuse and Objectionable Content

You agree and guarantee that you will NOT use the App and its features to create, generate, share, or disseminate any form of illegal or malicious content, including but not limited to:

Content Infringing on Others' Rights: You are strictly prohibited from using someone's likeness without their explicit consent. Any form of defamation, insult, invasion of privacy, violation of portrait rights, or other legal rights is forbidden.
False and Misleading Information: You are strictly prohibited from creating content intended to deceive others, spread false information, or conduct fraud, such as fake news, false statements, or misleading public information.
Obscene and Pornographic Content: You are strictly prohibited from creating or disseminating obscene or pornographic content. The creation of any form of non-consensual pornography (commonly known as "revenge porn") is strictly forbidden.
Harassment and Bullying Content: You are strictly prohibited from creating content used to harass, intimidate, bully, or threaten individuals or groups.
Hate Speech: You are strictly prohibited from creating content that incites discrimination, violence, or hatred based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other similar factors.
Other Illegal Activities: You are strictly prohibited from creating content that incites or promotes illegal activities.

Consequences of Violation: We have a zero-tolerance policy for any of the aforementioned misuse. Upon discovery of any violating content or behavior through proactive monitoring or user reports, we reserve the right to take all necessary actions without prior notice, including but not limited to: terminating your access to the App, and reporting to relevant law enforcement agencies and providing necessary information. You shall be solely liable for all legal consequences arising from your breach of these terms.

Intellectual Property Rights

The UI, source code and object code of the App, content of the Service, except content published by users (UGC), are intellectual property of FaceXSwap or provided to us by third parties. Any copying, modification, or distribution, except in the cases expressly specified in this agreement, is prohibited.
